How long does spousal sponsorship take?
IRCC targets 12 months for spousal sponsorship applications. Processing times can vary based on where the sponsored person lives and the completeness of the application. Outland applications (spouse outside Canada) are often processed faster than inland applications.
What is the difference between inland and outland sponsorship?
Inland sponsorship is for sponsored persons already in Canada on a valid status. Outland sponsorship is for sponsored persons outside Canada. Inland applicants can apply for an Open Work Permit while waiting. Outland applicants typically receive a decision and an immigrant visa before entering Canada.
Can I sponsor my common-law partner?
Yes. Common-law partners who have cohabited in a conjugal relationship for at least 12 consecutive months can be sponsored. Strong evidence of cohabitation and joint life (shared lease, joint bills, shared finances) is required. An RCIC helps you compile documentation that clearly demonstrates the cohabitation period.
What if my sponsorship application is refused?
You can appeal a spousal sponsorship refusal to the Immigration Appeal Division (IAD) of the Immigration and Refugee Board. The appeal must be filed within 30 days of the refusal. An RCIC (and/or immigration lawyer) with IAD experience can represent you through this process.
Do I have income requirements as a sponsor?
For spousal/partner sponsorship only (no dependent children), there is no minimum income requirement. If you are also sponsoring dependent children, you must meet the Low Income Cut-Off (LICO) threshold. An RCIC will confirm the income requirements for your specific family composition.
