If you are studying at a university or college at the bachelor's degree level or higher:
Your spouse or common-law partner may be eligible for an Open Work Permit (OWP) while you study. This allows them to work for any Canadian employer, in any position, without a job offer.
If you are studying at a college diploma or certificate level:
As of a 2024 policy change, spouses of students in diploma programmes are generally NOT eligible for open work permits, unless you are enrolled in a specific designated programme. This was a significant change from prior policy. Verify the current rules with IRCC before making plans.
How to apply:
- Your spouse applies online through IRCC as a dependent or separately
- They need to show the relationship (marriage certificate or proof of common-law partnership — typically 12 months of cohabitation evidence)
- Application fee: CAD 155
Children:
Dependent children of student visa holders can attend Canadian schools (K–12) without a separate study permit in most provinces.
Important: The spouse open work permit is tied to your study permit. If your study permit expires or you stop studying, their open work permit may be affected.
