AustraliaAsked by Ishaan Kapoor10 July 2026Visa condition 8516 is one of the standard conditions attached to most Australian student visas (subclass 500). It requires you to maintain enrolment in a registered full-time course of study for the duration of your visa.
What it means in practice:
- You must remain enrolled and attending your course at all times
- You cannot drop to part-time study unless the reduction is approved (e.g., due to documented illness, compassionate circumstances, or academic progression requirements)
- You must maintain satisfactory academic performance (not failing units repeatedly)
- Deferring, suspending, or withdrawing from your course without approval may breach this condition
When part-time study is allowed:
- In the final semester, if you only need to complete a reduced load to finish your degree
- Due to serious illness or injury with supporting medical documentation
- On compassionate or compelling grounds approved by your institution
Consequences of breaching 8516:
Your institution is required to report non-compliance to the Department of Home Affairs under the ESOS Act. This can lead to visa cancellation.
Condition 8105 (also common on student visas) limits your work hours (48 hours per fortnight during study periods).
If you need to reduce your study load for any reason, speak to your institution's international student office first. They can assess whether a formal reduction can be approved and reported correctly to avoid visa consequences.
Do not make any changes to your enrolment without understanding the visa implications. A MARA-registered migration agent can advise if you are unsure.
