Frequently asked questions
Is DACA still active and can I apply now?+
DACA has been subject to ongoing litigation and its status changes frequently. USCIS continues to accept renewal applications for existing DACA holders. Consult an immigration attorney for the most current status and what applies to your situation.
Does DACA or TPS lead to a green card?+
Neither DACA nor TPS directly provides a path to permanent residence. However, having DACA or TPS does not prevent you from pursuing a green card through other means — such as marriage to a US citizen or an employment-based petition.
What work authorisation does DACA provide?+
DACA provides an Employment Authorization Document (EAD) that allows you to work legally in the US for the 2-year duration of the DACA grant. DACA recipients can obtain Social Security numbers and, in most states, driver's licenses.
What countries currently have TPS designation?+
TPS designations change. Countries with active TPS designations have included Afghanistan, El Salvador, Haiti, Honduras, Nepal, Nicaragua, Syria, Ukraine, Venezuela, and others. Check the USCIS website for the current list.
Can I travel outside the US on DACA?+
DACA recipients can apply for Advance Parole to travel outside the US for humanitarian, educational, or employment purposes. Traveling without Advance Parole can result in loss of DACA status. Consult an attorney before any international travel.
